The agreement between you and Lifted Spirits
These Terms explain what you can expect from Lifted Spirits and what we expect from you. We have written them to be clear and proportionate. Nothing in these Terms removes any legal rights that cannot lawfully be excluded.
About these Terms
These Terms of Service (the Terms) form an agreement between you and Lifted Spirits Community (Lifted Spirits, we, us or our).
They apply when you access or use our website, community hub, member features, Discord community, online events, real-life meet-ups, paid memberships and any related services that link to these Terms (together, the Services).
Our Privacy Policy explains how we handle personal information. It is separate from these Terms and does not turn acceptance of these Terms into consent for optional marketing or unrelated data use.
If you do not agree to these Terms, you must not create an account or continue using the Services.
Eligibility and accounts
You must be 18 years of age or older to create an account, join the community or attend a Lifted Spirits event. By using the Services, you confirm that you meet this requirement and can enter into a contract with us.
You agree to provide information that is accurate and reasonably complete, and to keep important account information up to date. Your account is personal to you. You must not share your password, allow another person to use your account, impersonate another person or create an account to avoid a restriction or ban.
You are responsible for taking reasonable steps to protect your login details. Tell us promptly at socials@lifted-spirit.co.uk if you believe your account has been accessed without permission.
Lifted Spirits is a peer-support community
Lifted Spirits exists to support friendship, encouragement, shared experience and genuine community connection. Members may discuss mental health, heartbreak, loneliness, recovery, coping strategies and other personal experiences.
Lifted Spirits, its directors, moderators, support team members, volunteers and community members are not acting as your doctor, therapist, psychologist, psychiatrist, counsellor, social worker, lawyer, financial adviser or other regulated professional, unless a person clearly states that they are providing a separate professional service and is authorised to do so.
Member conversations, community resources and personal experiences are not diagnosis, treatment, medication advice, legal advice, financial advice or crisis intervention. Using the Services does not create a doctor-patient, therapist-client, counsellor-client or other professional relationship.
Crisis and emergency situations
Lifted Spirits is not a crisis line, emergency service or continuously monitored service. We cannot provide emergency intervention, suicide prevention, crisis counselling, medical treatment, welfare checks or an emergency response.
If you are at immediate risk of suicide, self-harm, harming another person or any other emergency, contact the emergency services now. In the UK, call 999 or 112. If you are outside the UK, contact the emergency services where you are.
Do not rely on a post, direct message, moderator, volunteer or community event as your only source of support during a crisis. A community member may not see or respond to your message in time.
Where we reasonably believe there is a serious and immediate risk, we may take proportionate safety steps, which can include escalating a report, preserving relevant information or contacting an appropriate service where lawful and practicable. We cannot promise that we will identify every risk or be able to intervene.
Community standards
You must treat other people with respect and use the Services in a lawful, honest and safe way. You must not:
- harass, threaten, stalk, intimidate, bully, exploit or deliberately humiliate another person;
- post hateful or discriminatory content, or target somebody because of a protected characteristic;
- encourage, instruct, romanticise or facilitate suicide, self-harm, eating disorders, dangerous substance misuse or violence;
- share another person’s private information, messages, images or recordings without a lawful basis or appropriate permission;
- post sexual exploitation, non-consensual intimate content, unlawful pornography or content involving a person under 18;
- impersonate somebody, misrepresent your identity or qualifications, operate a scam, request money dishonestly or manipulate vulnerable members;
- send spam, malicious links, malware, unauthorised advertising or repeated unwanted contact;
- use the Services to arrange unlawful activity, evade enforcement or interfere with security and access controls; or
- retaliate against a person for making a genuine safety report.
Members may discuss difficult experiences, including self-harm or suicidal feelings, when the purpose is support and the discussion does not provide harmful instructions, glorify harm or place other members at unreasonable risk.
Moderation, reports and community safety
We may review reports and take proportionate action to protect members, the community and the Services. Depending on the circumstances, this can include removing content, limiting features, issuing a warning, muting a member, removing somebody from an event, suspending an account or permanently ending access.
We may act without advance notice where we reasonably believe there is an urgent safety, legal, security or evidence-preservation reason. We will try to make decisions fairly and in good faith, but we cannot guarantee that every report will lead to the outcome a reporting person requests.
You can report behaviour through the available reporting tools or by emailing socials@lifted-spirit.co.uk. Include enough information for us to understand the issue, but do not put yourself at further risk to collect evidence.
You may ask us to review a moderation decision by contacting the same email address. A review does not automatically pause a safety restriction.
Your content, journals and reflections
User Content means information you submit through the Services, including profile information, messages, comments, reflections, photographs, event information, journal entries and mood data.
You keep ownership of your User Content. You confirm that you have the rights needed to submit it and that doing so does not violate another person’s rights or the law.
Private content
Journal entries and mood information marked as private are not displayed to other members unless you choose to publish or share them. They may still be stored, processed, backed up and accessed by authorised systems or personnel where reasonably necessary to operate, secure and support the Services, comply with law or address a safety issue, as explained in our Privacy Policy.
Public or shared content
When you publish a reflection, profile item, event or other content to members, you give us a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, display and distribute that content only as reasonably needed to operate, secure and provide the Services. This licence ends when the content is deleted from active systems, subject to reasonable backup, legal, safety and record-keeping retention.
We may remove or restrict User Content that breaches these Terms, creates a material safety risk or must be removed by law. We do not claim ownership of your User Content.
Privacy and personal data
Our Privacy Policy explains what personal information we collect, why we use it, the lawful bases we rely on, how long we keep it and the rights available to you.
Accepting these Terms confirms your contractual agreement to use the Services. It is not consent to optional marketing or to personal-data processing that requires a separate choice. Where consent is the appropriate lawful basis, we will request it separately and explain how to withdraw it.
You should avoid posting information that you do not want other members to know. Community spaces can contain sensitive discussions, but no online community can guarantee that another member will not copy, record or misuse something they can see.
Member interactions and off-platform contact
Lifted Spirits helps people connect, but we cannot guarantee the identity, honesty, intentions, qualifications or behaviour of every member.
Use reasonable care when sharing personal information, sending money, moving a conversation to direct messages, exchanging phone numbers, using social media, joining video calls or meeting in person. Never send money or financial information because another member pressures you to do so.
We cannot continuously monitor private messages, phone calls, text messages, social-media contact, video calls or other interactions outside the parts of the Services we control. Our moderation rules can still apply where off-platform conduct creates a credible risk to members or the community and is sufficiently connected to Lifted Spirits.
Report suspected scams, threats, coercion or serious misconduct to us and, where appropriate, to the relevant platform, police or emergency service.
Online events and real-life meet-ups
Events and meet-ups may be organised by Lifted Spirits, volunteers, members or third parties. The relevant event page should explain the organiser, location, timing, price and any specific conditions that apply.
When attending an event, you agree to follow reasonable safety instructions, venue rules and these Terms. You remain responsible for deciding whether an activity is suitable for you, arranging safe travel, checking weather and accessibility, bringing appropriate equipment and managing your own health needs.
Event descriptions, expected attendance, routes, weather information and plans can change. We will try to communicate material changes through the event page or community channel where reasonably possible.
If you feel unsafe, leave the situation and seek appropriate help. Report serious concerns to us. We do not guarantee the conduct of attendees, but this does not remove any responsibility we have where the law says it cannot be excluded.
Volunteers, moderators and support team members
Many moderators, support team members, event helpers, streamers and community helpers give their time voluntarily. Their role is limited to community support, moderation, events and helping maintain the community.
They are not providing treatment, counselling, crisis intervention, medical care or another regulated professional service on behalf of Lifted Spirits unless this is explicitly stated in writing.
Be respectful towards volunteers and follow reasonable moderation or safety directions. Concerns about a team member should be reported through our official contact route rather than pursued through personal accounts or repeated direct contact.
Paid memberships, renewals and cancellation
The core Lifted Spirits community is free. Optional paid memberships or features may provide additional participation, tools or benefits.
Before you buy, we will show the price, billing frequency, minimum term if any, trial terms, included features and how to cancel. A recurring membership continues and charges at the stated interval until it is cancelled.
You can cancel future renewals using the account or subscription-management option made available to you, or by contacting us. Unless the checkout terms say otherwise, cancellation stops future renewal and paid access continues until the end of the period already paid for.
Where a free or discounted trial converts into a paid membership, the conversion date and price will be shown before you start the trial. You are responsible for cancelling before the stated renewal date if you do not want the paid period to begin.
We may change prices or paid features. Where a change materially affects an existing recurring membership, we will give reasonable advance notice and explain when it takes effect. You can cancel before the new price applies.
Payments may be handled by an authorised payment provider such as Stripe. A failed or reversed payment can result in paid access being paused while the issue is resolved.
Cancellation and refund rights
Nothing in these Terms limits your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other law that applies to you. Any legal cancellation right, refund right or remedy continues to apply.
If you ask for a service to start during a statutory cancellation period, the consequences of doing so will be explained at checkout where required. We will not rely on a loss of cancellation rights unless the legal requirements for doing so have been met.
Event tickets, merchandise and other purchases
Tickets, merchandise and one-off purchases may have additional terms shown before payment, including event-specific cancellation, transfer or refund conditions. Those additional terms form part of your agreement for that purchase.
An event ticket may be non-refundable where the law permits and this is made clear before purchase. If an event is cancelled by us, the event-specific terms and your legal rights will apply. Costs you arrange separately, such as travel or accommodation, are your responsibility unless the law requires otherwise.
Merchandise supplied through a third-party store or fulfilment provider may also be subject to that provider’s delivery and returns process. This does not remove any rights you have against the seller identified at checkout.
Third-party platforms and services
The Services may connect to or rely on third parties such as Discord, Stripe, mapping providers, social platforms, venues or merchandise providers. Their own terms and privacy notices may apply when you use their services.
We do not control a third party’s availability, security, moderation decisions or independent conduct. We are not responsible for a third party merely because we link to it, although nothing in this section removes responsibility that the law places on us.
Lifted Spirits intellectual property
The Services, brand, logos, design, software, graphics and original content are owned by us or used with permission. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Services in accordance with these Terms.
You must not copy, sell, license, scrape, reverse engineer, interfere with, create unauthorised derivative works from or commercially exploit the Services, except where the law expressly permits it or we give written permission.
You may share official public Lifted Spirits links and posts using the sharing tools provided, provided you do not misrepresent your relationship with us or alter the material in a misleading way.
Service availability and changes
We aim to keep the Services available and secure, but we do not promise uninterrupted or error-free access. Maintenance, security work, third-party outages, technical problems or events outside our reasonable control can affect availability.
We may improve, replace, restrict or discontinue features. If a change materially reduces a paid service during a period you have already paid for, we will act fairly and provide any remedy required by law.
We may use reasonable security controls, usage limits and technical restrictions to protect members and the Services.
Suspension, termination and account closure
You may stop using the Services and request account deletion through the available account process or by contacting us. Cancelling a paid renewal and deleting an account are separate actions unless we clearly say otherwise.
We may restrict, suspend or terminate access where we reasonably believe you have materially or repeatedly breached these Terms, created a safety or legal risk, failed to pay an amount due, abused the Services or tried to evade an earlier restriction.
Where appropriate, we may give you notice and an opportunity to address the issue. We may act immediately where delay could create a safety, security, legal or evidence-preservation risk.
After closure, some information may be retained or removed as described in our Privacy Policy. Public contributions may remain where reasonably necessary for conversation continuity, legal records or safety, but may be anonymised where appropriate.
Accuracy and disclaimers
Members may share information that is incomplete, inaccurate, outdated, misunderstood or based only on personal experience. You should independently verify important information and seek an appropriately qualified professional where needed.
We do not guarantee that using Lifted Spirits will create a particular friendship, improve a health condition, lead to recovery, prevent harm or produce a specific personal outcome.
The Services are provided with reasonable care and skill as required by law. Other than rights and promises that cannot lawfully be excluded, the Services are provided based on the features and information made available at the relevant time.
Our responsibility to you
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, or any other liability that cannot lawfully be excluded or limited.
Subject to that, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. A loss is foreseeable if it was obvious that it would happen or both you and we knew it might happen when the agreement was made.
The Services are provided for personal, non-commercial use. We are not responsible for business losses such as lost profit, lost revenue, business interruption or lost business opportunity.
We are not automatically responsible for the independent conduct, advice or decisions of another member, volunteer, event attendee or third party. This does not affect responsibility we may have for our own acts or omissions under applicable law.
Complaints, governing law and courts
If you have a complaint, contact socials@lifted-spirit.co.uk with enough information for us to understand the issue. We will try to respond and resolve it fairly.
These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the UK, you keep any mandatory rights provided by the law where you live and may be able to bring proceedings in your local courts. If you live outside the UK, mandatory local consumer protections may also apply.
We do not require consumer disputes to be resolved through mandatory private arbitration. You and we can agree to use mediation or another dispute-resolution process, but doing so does not remove your right to use a court where you are legally entitled to do so.
Changes to these Terms
We may update these Terms to reflect changes to the Services, community safety needs, legal requirements or business practices.
If a change is material, we will provide reasonable notice through the Services, email or another appropriate method. Where appropriate, we may ask you to accept the new version before continuing to use some or all of the Services.
Changes will not reduce rights or remedies that have already arisen unless the law allows it. The version and last-updated date at the top identify the Terms currently in effect.
General terms
If any part of these Terms is found to be unlawful or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not mean that right has been waived.
You may not transfer your account or your rights under these Terms to another person. We may transfer our rights or obligations as part of a legitimate reorganisation or transfer of the Services, provided this does not reduce your rights.
These Terms, the Privacy Policy and any purchase- or event-specific terms shown to you form the agreement between you and us about the Services. If specific terms conflict with these general Terms, the specific terms apply to that purchase or event to the extent of the conflict.
